USCIS response deadlines for agency requests, such as Requests for Evidence, loosen due to COVID-19.

Don’t sweat your USCIS response deadlines too much during COVID-19, as you, your family, and/or your business probably have an extra sixty (60) days to respond to agency requests, depending on your individual immigration case circumstances and when your notice was issued.

Usually, if you fail to respond to USCIS notices by the date indicated, your case is automatically denied.

Original USCIS Response Deadlines Announcement

Due to COVID-19, the agency announced on March 27, 2020, that applicants/petitioners/respondents of USCIS RFEs (Requests for Evidence) and NOIDs (Notice(s) of Intent to Deny) dated March 1 – May 1, 2020, have an additional sixty (60) calendar days to respond before action is taken on their case.

“Action” typically means approval, denial, or other decisions made on the case. So, if you received a notice of Request for Evidence or a Notice of Intent to Deny between these dates, you can still file your response 60 calendar days late without the USCIS taking action.

Supplemental USCIS Response Deadlines Announcement

On May 1, 2020, the USCIS announced it is extending those dates through July 1, 2020, and also included more types of notices in its announcement due to COVID-19. The following notice types are also included in the deadline extension: Continuations to Request Evidence (Forms N-14), Notices of Intent to Revoke, Notices of Intent to Rescind and Notices of Intent to Terminate regional investment centers, and filing date requirements for Forms I-290B, Notices of Appeal or Motion, filed with the Administrative Appeals Office (AAO), the USCIS, or certain appeals and motions with Immigration and Customs Enforcement (ICE).
